Singh and Sri A.P. Singh, learned counsels for the writ petitioner and Sri Brijesh Kumar Srivastava, learned Standing Counsel for the State. 2. Sri Brijesh Kumar Srivastava, learned Standing Counsel has made a statement that he is well equipped with the instructions and is in a position to argue the case. He does not propose to file any counter affidavit and he further submits that the writ petition be decided on the basis of the documents available on record. 3. With the consent of the parties, the writ petition is being decided at the fresh stage. 4. The case of the writ petitioner is that he was appointed as Home Guard in Maharajganj, however, owing to lodging of a criminal case being Case Crime No.28 of 2020, under Section 419, 420, 467, 468, 471 IPC, the writ petitioner was issued a show cause notice, to which the writ petitioner tendered his reply and thereafter his service
