Although against an order calling for exchange of counter and rejoinder affidavits, a special appeal under Chapter VIII Rule 5 of the Rules, 1952 would ordinarily be not maintainable, however, in the Full Bench decision in 'Ashutosh Shrotiya & Ors. vs. Vice-Chancellor, Dr. B.R.
