This special appeal was filed on 28.04.2006. As reported, there is a delay of one year, two months and six days in filing of this appeal. We have gone through the affidavit in support of the application for condonation of delay and do not find the explanation offered therein to be satisfactory when tested on the anvil of the recent judgment of Hon'ble the Supreme Court in the case of 'Shivamma (Dead) by LRS vs. Karnataka Housing Board and another' reported in 2025 SCC OnLine 1969.
