Learned counsel for the applicant has contended that the allegation against the applicant is that he on the pretext of marriage had established physical relations. Learned counsel for the applicant has contended that the victim is major and that she was in consensual relation with the victim out of her own free will and consent. Learned counsel further argued that the complicity of applicant in commission of alleged is not made out and that the ingredients of Section 69 of B.N.S.S., is not attracted in the present case. It is thus contended that the applicant is innocent and has been falsely implicated in the present case.
