Learned counsel for the applicant submits that the applicant is named in the F.I.R. along with one other accused-Ghanshyam. In the F.I.R. the victim made allegation of rape against the applicant, whereas, for another accused-Ghanshyam, she stated that he had made video of such incident. The F.I.R. has been lodged after six months of the alleged incident without there being any plausible explanation of delay. In her statement recorded under Section 180 BNSS the victim has made allegation of rape against both the accused including the applicant, whereas, in her statement recorded under Section 183 BNSS she has made allegation of rape against the co-accused, Ghanshyam.
