Learned counsel for the applicant submits that the applicant is named in the F.I.R. He is absolutely innocent and has been falsely implicated in the present case. Learned counsel for the applicant further submits that though in the F.I.R. as well as in her statements recorded under Section 180 & 183 B.N.S.S. the victim has alleged that having knowledge that she is a widow lady, the applicant on false promise of marriage had established sexual relation with her for six years, thereafter, he refused to marry her. Learned counsel further submits that victim is major and widow woman aged about 35 years and is also a mother of two children.
