Learned counsel for the applicant submits that the victim is the daughter-in-law of the applicant. False and frivolous allegation has been made against the applicant that he had committed her rape two years earlier and thereafter several times. There is an inordinate delay of more than two years in lodging of the F.I.R. No date and time of the alleged incident has been disclosed by the victim in her statements recorded under Sections 180 & 183 BNSS or in the F.I.R. It appears that on account of family dispute the applicant has been implicated in the case with false and frivolous allegations due to malafide intention and ulterior motive.
