Learned counsel for the applicant submits that in the F.I.R. the victim states that on the date of occurrence when she was alone in her house the applicant reached there and after falling her down on a cot he committed her rape forcibly and when she made noise he pressed her mouth, thereafter, while hurling abuses the applicant had assaulted her with lathi- danda and bricks and thereafter while threatening her he fled away. In her statements recorded under Sections 180 & 183 BNSS has supported the version of F.I.R. Learned counsel further submits that the victim is major and married woman and is mother of two children.
