Court No. - 3 HON'BLE DR. GAUTAM CHOWDHARY, J. 1. Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material brought on record. 2. Learned counsel for the applicant submits that the F.I.R. dated 21.10.2025 was lodged by the informant alleging therein that on 14.10.2025 at about 8:00 hours in the night when her wife went to sleep the applicant entered into the house and committed her rape forcibly. Learned counsel further submits that though the alleged incident took place on 14.10.2025 and the F.I.R. with regard to the said incident has been lodged on 21.10.2025 without there being any plausible explanation of such an inordinate delay of five days. Learned counsel further submits that though the victim in her statements recorded under Sections 180 & 183 BNSS has made specific allegation of rape against the applicant, but a perusal of both the statements of the victim goes to show that the applicant was known
