Kanaujiya, learned A.G.A.-Ist for the State and perused the judgment and trial court record. 2. The above noted criminal appeal has been preferred against the judgment and order dated 31.10.85/2.11.85 passed by Additional District & Sessions Judge, Moradabad, in Sessions Trial No.25 of 1985, convicting and sentencing the appellants to life imprisonment under section 302/149 I.P.C., to 1 year R.I. under section 147 I.P.C. to 6 months. R.I. under Section 323/149 I.P.C. and further 6 months R.I. under Section 323/149 I.P.C., all the sentences to run concurrently. 3. The prosecution case is that the incident is a
