The present criminal appeal has been filed against the judgment and order dated 20.08.1985 passed by Addl. Sessions Judge, Shahjahanpur, in Sessions Trial No. 642 of 1984 convicting the appellant for life imprisonment under section 302/34 of I.P.C. 3. The complainant, Ram Chander, son of Late Thakuri, P.W.-2, Ram Ratan, son of Late Thakuri and accused, Puttan, son of Rashid Khan, Ram Lal son of Pohpi and Krishan Kumar, son of Gulab are the residents of the same village.
