In compliance with our order dated 02.02.2026, requiring the appellant to appear in-person before us, the learned Chief Judicial Magistrate, Ghaziabad has submitted a report dated 09.02.2026 placed at Flag 'B'. A perusal of the learned Chief Judicial Magistrate's report dated 09.02.2026, shows that the appellant- Zamil S/o Mustzab, upon inquiry held, has been found to have died on 30.08.2022. A perusal of the report also shows that the testimony of Anuj Bharti, Sub Inspector of Police, who has been deputed to serve the appellant and to enquire about the whereabouts, has said on oath before the learned Chief Judicial Magistrate that the appellant is dead. Likewise, the statement of Deen Mohammad S/o Zamil too has been recorded, which shows that his father passed away on 30.08.2022.
