Heard Shri Prabodh Kumar Bajpai, learned counsel for the petitioner. 2. In view of the order, which is being proposed to be passed today, notices are not being issued to the respondent no. 2, borrower. 3. The case of the petitioner is that it happens to be a financial institution being Bank, a body corporate constituted under the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970. The respondent no. 2 who happened to be a borrower did not stick to the timelines and the financial discipline pursuant whereto on 12.04.2018, the petitioner's bank invoked the guarantees and the account was termed to the NPA. Proceedings under the SARFAESI Act, 2002 stood initiated and a demand notice under Section 13(2) came to be issued on 28.10.2021 and since the borrower did not honour the commitments and made the payment of the dues so it is claimed that possession notice
