The counsel for the rival parties have made a joint statement that they do not propose to file any further affidavits thus with the consent of the parties, writ petition is being decided at the fresh stage. 3. The case of the respondent no. 2, M/s. M.M. Traders through its partner Shri Vimal Kumar Agarwal resident of 51/56 Shakkarpatti, Kanpur, Uttar Pradesh is that it happens to be the borrower who has been accorded financial assistance by the petitioner's bank. On account of the non- maintenance of the financial discipline proceedings under the Securitisation and Reconstruction of Financial Assets and Enforcement
