The present petition has been filed challenging the order of the respondent no. 2 dated 4.11.2025 and the order dated 24.5.2000 passed by the respondent no. 3, decreeing the suit ex-parte against the petitioners. 3. It is contended by the learned counsel for the petitioners that the predecessor in interest of the petitioners filed a suit for declaration which was dismissed as having been abated as the substitution in respect of the deceased defendants were not filed. The said order of the Sub Divisional Officer, Ballia, dated 26.7.1996 was set aside in appeal by the order of the Commissioner, Azamgarh Division, dated 7.9.2001 and the suit was restored to its original number being Case No. 119 of 1995. 4.
