Brief facts of the Case are that Khasara no- 423 was recorded in the name of Shiv Narayan. A will deed was alleged to be executed on 16.6.1959 by Shiv Narayan in favour of respondent no.5/Sanatan Dharm Shiksha Prasar Samiti. A Civil Suit No. 506 of 1963 filed by Shiv Narayan for cancellation of will deed dated 16.6.1959 was decreed vide judgment & decree dated 25.9.1965 cancelling the will deed dated 16.6.1959. A suit under section- 229 B of U.P. Zamindari Abolition & Land Reforms Act, 1950 (hereinafter referred to as 'U.P.Z.A.& L.R. Act') filed by respondent no-5 / Sanatan Dharam Shiksha Prasar Samiti was dismissed vide judgment & decree dated 30.5.1966.
