HON'BLE AMITABH KUMAR RAI, J. 1. Heard Sri S.B. Pandey, learned Senior Advocate/Additional Solicitor General assisted by Sri Varun Pandey, appearing for the Union of India. Sri Rakesh Singh, respondent has appeared in person. 2. It has been submitted by learned counsel for the Union of India that the opposite party was appointed as Assistant Works Manager (Probation) in Junior Time Scale on 02.07.2012 and after completing his training he was posted in the Ordnance Factory, Kanpur. In 2016, opposite party was eligible and was duly promoted in the pay scale of Rs.15,600 - 39,100 + Grade Pay Rs.6,600 w.e.f. 01.04.2016. 3. It is during the aforesaid promotion that the petitioners came to know that a criminal case is pending against opposite party being Criminal Case No. 586 of 2013, under Sections 323, 504, 498A and 506 IPC, which has been instituted
