After hearing the parties and perusing the records ultimately what comes out is, that initially in the disciplinary proceedings initiated against the respondent/ petitioner, an enquiry report was submitted on 30.11.2016 exonerating him. Inspite of it a show cause notice dated 05.03.2017 was issued and thereafter another show cause notice dated 25.06.2019, annexing therewith an enquiry report dated 04.06.2019, was issued. These notices were put to challenge by the respondent/ petitioner in Writ Petition bearing no. 22962 (S/S) of 2019. The said petition was disposed of. The impugned notice and the enquiry report dated 04.06.2019 were quashed with a finding that subsequent to it on 03.09.2019 the Managing Director of the Corporation remitted the proceedings back for fresh enquiry after due opportunity of hearing to the petition
