The present Petition has been filed under Section 11(6) of the Arbitration and Conciliation Act, 19961 seeking the appointment of a Sole Arbitrator to adjudicate upon the disputes inter se the parties. 2. The Arbitration Clause is set out at Clause 13.8 of the Service Agreement dated 30.09.20232 which reads as under: “13.8. Dispute Resolution. Any dispute, claim or controversy arising under or relating to the Agreement, including without limitation any dispute concerning the existence or enforceability hereof (“Dispute”), shall first be attempted to be 1 Act 2 Agreement 3. Material on record reflects that a notice invoking Arbitration under Section 21 of the Act was issued on 22.10.2025. 4. Mr. Deepak, learned counsel appearing for the Respondent, submits, on instructions, that the
