The present Petition has been filed under Section 11(6) of the Arbitration and Conciliation Act, 19961 seeking the appointment of a Sole Arbitrator to adjudicate upon the disputes inter se the parties. 2. The Arbitration Clause is set out at Clause 13.8 of the Service Agreement dated 30.09.20232 which reads as under: “13.8. Dispute Resolution. Any dispute, claim or controversy arising under or relating to the Agreement, including without limitation any dispute concerning the existence or enforceability hereof (“Dispute”), shall first be attempted to be 1 Act 2 Agreement Signature Not Verified Digitally Signed ARB.P. 400/2026 Page 1 of 7 By:NEERU Signing Date:21.04.2026 17:10:31 resolved by discussions between the senior representatives (as appropriately authorised) of the Parties. In the event any such Dispute is unable to be resolved through such discussions within a period of thirty (30) days, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time, by a Sole Arbitrator, to be appointed as per law. The venue of the Arbitration shall be New Delhi only. The language of the arbitration proceedings and award shall be English. It is expressly agreed between the parties that any Dispute shall subject to exclusive jurisdiction of courts at New Delhi, India only.” 3. Material on record reflects th
