Shri Hemant Kumar Mishra, learned counsel for the petitioner invites our attention to an order passed under Section 38 (1) of the U.P. Revenue Code, 2006 on 29.11.2022 recording Gata Nos. 3793 (0.96D), 3850 (0.42D), 3851(3.01D), 3871 (1.43D) and 3873 (4.72D) situated in Village- Nawabganj Kasba, Tehsil-Tarabganj, District- Gonda in the name of pond land after striking out the name of the khateders. The suit filed by some of the encroachers has also been disposed of as is evident from the counter affidavit of the District Magistrate concerned, however, the District Magistrate
