The present petition has been filed under Section 11(6) of the Arbitration and Conciliation Act, 19961, seeking the appointment of an Arbitrator to adjudicate upon the disputes inter se the parties. 2. The Arbitration Clause is set out at Clause 6 of the Vendor Agreement Dated 16.09.20242, which reads as follows: “6. Governing Law and Jurisdiction This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with this Agreement shall be resolved through arbitration in New Delhi, as chosen by the initiating party, in accordance with the Arbitration and Conciliation Act, 1996. The arbitration proceedings shall be conducted in English and each Party shall bear its own costs. The decision of the arbitrator shall be final and binding on both Parties.
