The present petition has been filed by the petitioner under Article 227 of the Constitution of India, 1950, assailing the order dated 22nd March, 2023 passed by the learned Trial Court in Civil Suit No. 36/2017, whereby the application under Order VI Rule 17 read with Section 151 of the Code of Civil Procedure, 1908 (hereinafter referred to as ‘CPC’), filed on behalf of the petitioner/defendant seeking amendment of the written statement, has been dismissed. 2. I have heard the learned counsel for the parties and perused the record. 3. Learned Counsel for the petitioner has argued that the learned trial court has passed the impugned order on the basis of surmises and conjectures which is against the facts and law.
