In view of the order, which is being proposed to be passed today, notices are not being issued to the plaintiff-respondent no.2. 3. The case of the defendant-petitioner is that an Original Suit no.85 of 2020 came to be instituted by the plaintiff-respondents, Smt. Shanti Devi vs. Vipin and others seeking declaration against the defendant-petitioners. According to the defendant-petitioner, the defendant no.5 in the said suit Rishi Pal expired on 09.12.2020. However, the suit so instituted by the plaintiff- respondents came to be dismissed exparte on 30.08.2024 by the Court of Addl. Civil Judge (Jr. Div.), Court No.4, Moradabad that too without informing and doing the necessary follow up post demise of defendant no.5. Thereafter,
