Heard Shri Sanjai Kumar Pandey, learned counsel for the plaintiff- petitioners. 2. The case of the plaintiff- petitioners is that an Original Suit No. 104 of 2015 came to be instituted by the original plaintiff- petitioners being Dinesh Chandra son of late Ram Lakhan seeking a decree of permanent injunction restraining the defendant-respondent from interfering in the subject land being Gata No. 157 and 158 Village Ramgarh which contains Sahan and Rasta being ABCDA on 15.04.2016 along with suit, an application under Order 39 Rule 1 and 2 CPC came to be preferred. The Court of Civil Judge (Senior Division), Siddharth Nagar rejected the temporary injunction application on 07.10.2021 against which a Misc. Civil Appeal No. 22 of 2021 came to be preferred by the original plaintiff- Dinesh Chandra and during the pendency of the same, on 25.10.2021, the original plaintif
