In view of the order, which is being proposed to be passed today, notices are not being issued to the defendant opposite parties. 3. The case of the plaintiff-petitioner is that an Original Suit No.236 of 2004, Jaswant Singh vs. Suresh Chandra came to be instituted before the Court of Civil Judge (Jr. Div.), Etawah for cancellation of the sale deed. The said suit was instituted on 13.07.2004 and on an application for commission and service of notice through Amin was moved which was allowed and based upon the report of the Amin being Paper no. 18Kha, when he reached at the disputed property on 23.03.2004, the defendant was not found based upon the same on 25.08.2004, the trial court holding the service sufficient upon the defendant vide order dated 19.04.2005 proceeded exparte against the defendant.
