The counsel for the rival parties have made a joint statement that they do not propose to file any further affidavits thus with the consent of the parties, writ petition is being decided at the fresh stage. 3. The case of the plaintiff-petitioner is that he along with others, in representative capacity, instituted O.S. No. 217 of 2023 before the court of Civil Judge (Junior Division), Haweli, Azamgarh seeking permanent injunction restraining the respondents' firm either enclosing the subject land over which there happens to be a statue of Ambedkar and the institution and not to construct a police chowki. Along with the said suit, an application under Order 39 Rule 1 an
