Heard Sri Rajan Tripathi, learned counsel for the plaintiff-petitioners and Sri Anand Prakash Paul for the defendant-respondent no.1. 2. In view of the order, which is being proposed to be passed today, notices are not being issued to the defendant-respondent no.2. 3. The case of the plaintiff-petitioners is that an Original Suit no.582 of 2000 came to be instituted by the plaintiff-petitioner being Rangi Lal vs. Ram Ajor and others, before the Court of Civil Judge (Senior Division), Kanpur Nagar, which came to be decreed exparte on 19.10.2000 by the Court of Civil Judge (Senior Division), Kanpur Nagar. An application under Order IX Rule 13 read with Section 151 of CPC came to be preferred by the defendant- respondent no.1, i.e. Kanpur Development Authority, however, during the pendency of the said proceedings, Rangi Lal, original plaintiff, expired on 22.07.2005
