Heard Sri Krishna Bihari Srivastava, learned counsel for the plaintiff- petitioner and Sri Rajesh Kumar Singh as well as Sri Bijay Kumar Srivastava, counsel for the defendant-respondent nos. 1 to 6. 2. In view of the order, which is being proposed to be passed today, notices are not being issued to the proforma defendant-respondent. 3. The counsel for the rival parties have made a joint statement that they do not propose to file any further affidavits thus with the consent of the parties, writ petition is being decided at the fresh stage. 4. The case of the petitioner is that he along with his father and mother instituted in O.S. No. 432 of 1994 before the court of Munsif, Mirzapur, (Lal Ji Singh v. Amar Nath Tiwari and others) seeking a decree in favor of the plaintiff-petitioner against the defendant-respondent to demo
