Under challenge is the order date 28.01.2026 passed in Civil Revision No.93 of 2023 passed by A.D.J Court no.1, Gonda whereby civil revision preferred by the petitioner was dismissed as a consequence the order passed by the trial court dated 16.09.2023 whereby an application preferred by the petitioner under Order VII Rule 11 CPC was rejected and was affirmed by the revisional court. Submission of learned counsel for the petitioner is that the mother of the private respondent nos.1, 5 to 7 had executed a sale deed in favour of the respondent nos.2 and 3 in the year 1984 in respect of some part of the land thereafter the private respondent nos.2 and 3 sold the property which they had purchased from the mother of the private respondent nos.1, 5 to 7 in the year, 2004.
