Heard learned counsel for the petitioner. By means of the instant petition, the petitioner assails the order dated 14.08.2025 passed by A.D.J Court No.9 Lucknow in Misc. Case No.626 of 2025 whereby an application moved by the petitioner seeking recall of the order dated 06.05.2025 was rejected. Submission of learned counsel for the petitioner is that the petitioner had instituted a regular suit bearing no.695 of 2006 before the Civil Judge (Junior Division) Hawali Lucknow. The suit was dismissed exparte against the petitioner on 23.02.2008. The petitioner being aggrieved from the exparte decree filed a Regular Civil Appeal No.64 of 2008 under Section 96 CPC.
