The present Petition has been filed under Section 11(6) of the Arbitration and Conciliation Act, 19961, seeking the appointment of a Sole Arbitrator to adjudicate the disputes inter se the parties arising out of the Agreement for Taking Possession for Fit Outs dated 20.08.20212 executed between the parties. 2. The relevant Clause being Clause 38 of the Agreement reads as under: “38. Any dispute or difference between the parties hereto concerning the construction, interpretation or application arising out of this Agreement or otherwise any issues concerning the Lease/License/Occupation/Use of the premises shall be referred to the sole arbitrator to be appointed by Ambience.
