Heard Ms. Madhulata, Advocate, holding brief of Sri Rafeek Ahmad Khan, learned counsel for the applicant, Sri Rakesh Kumar Mishra, learned A.G.A. for the State and perused the record. 3. The instant bail application has been filed with a prayer to release the applicant on bail in Case Crime No. 437 of 2025, under Sections- 103(1), 238, 191(2), 3(5) of B.N.S., Police Station- Kotwali Nagar (Mahoba), District- Mahoba, during the pendency of the trial. 4. Contention of learned counsel for the applicant is that in the FIR, though the applicant was named as one of the accused, but the allegation against the applicant has been made on the basis of doubt, though there was no eyewitness to the incident in question.
