Court No. - 64 HON'BLE VIVEK VARMA, J. 1. Heard learned Counsel for the applicant and Sri V.P.Tripathi, learned A.G.A. for the State. 2. The instant bail application, under Section 483 BNSS, has been filed with a prayer to enlarge the applicant on bail in Case Crime No. 89 of 2025, under Sections 8/20/29 N.D.P.S.Act, Police Station Adarsh Mandi Shamli, District- Shamli, during pendency of the trial. 3. Counsel for the applicant submits that the applicant has been falsely implicated in the instant case. The name of the applicant was disclosed by co-accused Sagar @ Jani, who was arrested at the spot. The said statement insofar as it implicates the applicant is unreliable. False recovery of 279 gm. charas has been shown from the the co-accused Sagar @ Jani. There is no independent witness to the alleged recovery. The recovered contraband is below commercial quantity. The mandatory provisions of Sections 42, 50 and 52-A of the N.D.P
