Heard Ms. Mary Puncha (Sheeb Jose), learned counsel for the applicant, Sri Rakesh Kumar Mishra, learned A.G.A. for the State and perused the record. 2. The instant bail application has been filed with a prayer to release the applicant on bail in Case Crime No. 26 of 2015, under Sections 302, 34, 120B I.P.C., Police Station Nai Mandi, District-Muzaffarnagar, during the pendency of the trial. 3. Contention of learned counsel for the applicant is that, as per the prosecution story, an FIR was lodged regarding the murder of Akhil Gupta by two motorcycle-borne accused. Subsequently, the name of the applicant surfaced as an accused in the confessional statement of co-accused Kartik, though there is no recovery of any weapon or any other incriminating material either from the possession of the applicant or on his pointing out.
