The instant bail application has been filed seeking release of the applicant on bail in Case Crime No.179 of 2023, under Sections 323, 504, 326, 302 IPC, Police Station Atrauliya, District Azamgarh, during pendency of the trial. 5. Learned counsel for the applicant submits, this is second bail application filed on behalf of the applicant and his first bail application has been dismissed by this Court vide order dated 06.09.2024 after considering the fact that in the dying declaration of the deceased she made allegation that applicant who is jeth of the deceased alongwith his wife burnt her and even after considering this fact
