The instant bail application has been filed with a prayer to release the applicant on bail in Case Crime No.0765 of 2025, under Section 60, 60(2) of U.P. Excise Act and Section 274 of BNS, Police Station- Chaubeypur, District- Varanasi. 3. The Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. The maximum punishment prescribed for the offence mentioned against the applicant is three years. The applicant is in jail since 07.12.2025 and he is not a previous convict. 4. The Learned A.G.A. on the other hand, has opposed the prayer for grant of bail and has contended that applicant has criminal history of 6 other cases and all the cases against the applicant are under the provisions of U.P.
