Heard learned counsel for the applicant, learned AGA for the State and perused the record. The allegation in the prosecution case is that at about 7:00 p.m., while the complainant was returning from Hardoi to his residence, four named accused persons along with 8-10 unknown persons, allegedly armed with country- made pistols, iron rods, and sharp-edged weapons, on account of old enmity, assaulted the complainant and his brother. It is alleged that during the said incident, the complainant and his brother sustained injuries. Submission of learned counsel for the applicant is that the complainant himself did not sustain any injury and has not been medically examined.
