Court No. - 66 HON'BLE SAMEER JAIN, J. 1. Heard Sri Rakesh Kumar Yadav, learned counsel for the applicant and Sri Kunwar Tejendra Bhadur, learned AGA, for the State. 2. The instant bail application has been filed on behalf of the applicant with the prayer to release him on bail in Case Crime No.245 of 2025, under Sections 303(2), 317(2) and 317(4) BNS, Police Station Nagra, District Ballia during pendency of the trial. 3. Learned counsel for the applicant submits that however, as per allegation, from the possession of the applicant stolen motorcycle of the informant was recovered but entire allegations levelled against the applicant are totally false. 4. He further argued that even except the offence under Section 317(4)BNS, all the alleged offences are triable by Magistrate with maximum punishment of five years and there is no cogent evidence against the applicant with regard to offence under Section 317(4) BNS as there is no evidence
