Act which is mandatory. It is submitted that the weight of alleged opium has been found 2.6kg along with weight of packing material and as such, in case the weight of packing material is excluded then the actual weight would be below commercial quantity. No incriminating material has been recovered from the possession of the applicant and he has been made accused in this case on the basis of confessional statement of the co-accused.
