Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. 3. It is submitted by learned counsel for the applicant that applicant is being proceeded under Sections 287, 316(3), 305(b), 317(2), 317(4), 61(2), 112 of B.N.S., Section 23 of Petroleum Act, 1934, Section 8 of the Prevention of Corruption Act, 1988 & Section 3/7 of Essential Commodity Act. It is submitted by learned counsel for applicant that from the joint possession of accused persons 950 ltr diesel/petrol and one tanker, alto car, WagonR car, 11 plastic Jerrican of 15 ltrs etc. were recovered. However, from the personal recovery of the applicant two mobile phones and Rs. 2200/ have been recovered and th
