The instant bail application has been filed with a prayer to release the applicant on bail in Case Crime No. 637 of 2024, under Section- 317(3) BNS, Police Station-Bithari Chainpur, District-Bareilly, during the pendency of the trial. 3. Contention of learned counsel for the applicant is that applicant was released on bail in Criminal Misc. Bail Application No.191 of 2026 by this court under Sections-310(2) and 317(2) of BNS. However, while filing the chargesheet, the police added Section 317(3) BNS by removing Section 317(2) BNS, though material is same.
