The instant bail application has been filed with a prayer to release the applicant on bail during the trial in Case Crime No.584 of 2025, under Section 8/21 of NDPS Act, Police Station Gangoh, District Saharanpur. 3. Contention of learned counsel for the applicant is that the applicant is an innocent person and he has been falsely implicated in the present case. He further submitted that the applicant has been implicated on the basis of recovery of 35.71 gms. of smack (contraband), which is below commercial quantity and the same was kept by the applicant for his personal use. It is further submitted that the applicant has no criminal history. While recovering the aforesaid smack (contraband) from possession of the applicant, the procedure under Section 50 of t
