The present application has been moved seeking anticipatory bail in Case Crime No.568 of 2023 under Sections 4-0. 120B I.P.C., Police Station Baberu, District Banda, with the prayer that in the event of arrest, applicant may be released on bail. 3. Learned counsel for the applicant has contended that the applicant was a Panchayat Secretary at the relevant point of time and that the amount was released for construction of toilet in favour of beneficiary persons under the joint signature of Village Pradhan. The allegations of mis- appropriation of funds has been levelled against the applicant, whereas in the departmental proceedings, it has been found that the construction work was carried out by the applicant and that no charge has been made out.
