In essence, the learned counsel for the applicant contends that in the CCTV footage, the applicant is not shown present on the spot. 3. The learned A.G.A. has contended that he has received instructions in which only the contents of CCTV footage have been mentioned however, the identity of the accused as seen in the CCTV footage has not been disclosed. He states that investigation is still in progress and he may be permitted to seek fresh instructions as to the status of the investigation including the fresh developments with respect to the CCTV footage that have been collected during investigation. 4.
