By means of the instant appeal filed under Section 374(2) Cr.P.C., the appellant has challenged the judgment and order dated 01.05.2012 passed by the Additional Session Judge X-Cader, Unnao in Session Trial No.664 of 2010 arising out of Case Crime No.1033 of 2010 under Sections 363, 366, 376 IPC registered at Police Station- Makhi, District- Unnao, whereby the appellant has been convicted for the offence under Section 366 IPC and has been sentenced to undergo rigorous imprisonment for a period of five years and to pay Rs.5,000/- fine. In case of failure to pay fine, the appellant would undergo rigorous imprisonment for a further period of one year. 3.
