The instant Criminal Appeal under Section 374 CrPC read with 389 Cr.P.C has been filed against judgment and order dated 03.02.2004 passed by the Additional Sessions Judge, (Fast Track Court), Balrampur, in Sessions Trial No.76 of 2000, State of U.P. v. Ram Naresh, arising out of Case Crime No.188 of 1991, under Sections 323, 325, 308 I.P.C., Police Station Tulsipur, District Gonda (newly formed District Balrampur), convicting and sentencing the appellant as under:- (i) under Section 308 I.P.C. to five years rigorous imprisonment , the period of imprisonment already undergone in the case noted above, shall be adjusted in the quantum of sentence awarded as above, on amongst others. 3. As per prosecution version, incident is said to have taken place on 17.07.1991
