As per earlier order dated 13th March 2023, appeal has already been abated with regard to respondents 3 and 4 and is therefore being adjudicated upon with regard to appellants 1 and 2 i.e. Kamlesh and Siya Ram. 3. The instant Criminal Appeal under Section 374(2) CrPC has been filed against judgment and order dated 16th November, 2004 passed by Additional Sessions Judge /Fast Track Court No. 4, Hardoi in Sessions Trial No. 369/2003, State v. Kamlesh and others arising out of Case Crime No. 244 of 2000, under Sections 308, 323, 504, 506 I.P.C., Police Station Shahabad, District Hardoi convicting and sentencing the appellant as under:- (i) under Section 308/34 I.P.C. to four years rigorous imprisonment and a fine of Rs.500/- and in default of fine, one month's
