The instant Criminal Appeal under Section 374(2) Cr.P.C. has been filed against judgment and order dated 03.09.2007/05.09.2007 passed by the Additional Sessions Judge, F.T.C. Court No.8, Pratapgarh, in Sessions Trial No.374 of 2004, State v. Vinod Kumar and others, arising out of Case Crime No. 33 of 2001, under Sections 308/34, 324/34, 323/34, 504, 506 I.P.C., Police Station Baghrai, District Pratapgarh convicting and sentencing the appellants as under:- (i) under Section 323/34 I.P.C. to six months' simple imprisonment (ii) under Section 324/34 I.P.C to two years' rigorous imprisonment with a fine of Rs.1,000/- each and in default of fine, six months additional imprisonment (iii) under Section 308/34 IPC, to three years' rigorous imprisonment with a fine
