The instant Criminal Appeal under Section 374(1) CrPC has been filed against judgment and order dated 10.12.2003 passed by the Additional Sessions Judge (Court No.07), Barabanki, in Sessions Trial No.993 of 1997; State of U.P. v. Lallan & Ors. arising out of Case Crime No.07 of 1999, under Sections 323, 325, 336, 307, 504, 506 I.P.C., Police Station Baddupur, District Barabanki, convicting and sentencing the appellant as under:- (i) under Section 323/34 I.P.C. to three months simple imprisonment, under Section 325/34 I.P.C. to three years rigorous imprisonment and a fine of Rs.1,000/- and in default of fine, six months rigorous imprisonment, under Section 307/34 I.P.C. to five years rigorous imprisonment and a fine of Rs.2,000/- and
