The instant application under Sections 12 of the Contempt of Court's Act, 1971 has been filed against the alleged disobedience of the order of this Court dated 07.07.2023 passed in Second Appeal No. 540 of 1984 (Shamsuddin and others vs. Akhlaq Ahmad and others). 3. The relevant portion of the order dated 07.07.2023, referred, reads as under:- "50. Needless to say, the aforesaid submissions is without basis for the reason that neither there is any pleading nor any foundation for the same. This was not raised before the Trial Court and even before the Lower Appellate Court and argument was raised but it did not find favour with the Lower Appellate Court.
